In Texas, due to the current climate with tort reform, it has become increasingly difficult to pursue a claim in negligence. The belief “out there” is that ALL lawsuits are frivolous lawsuits.
I believe that litigation should be discouraged and compromise encouraged, and that the attorney, as a peacemaker, has that opportunity when advising his client, pointing out that often the nominal winner is the real loser in fees, expenses and waste of time. Having said that, I do not agree with the current trend today that all lawsuits are frivolous, as some are certainly necessary in light of negligence, in some cases gross negligence, and the damages and type of injuries sustained, or even the inability to get the defendant or the insurance company to play fair on their end.
